By using the Orky app and services ("Service"), you agree to be bound by these Terms of Use ("Terms").

1. Eligibility

• You must be at least 13 years old to use this Service.
• You must provide accurate and complete information when creating an account.

2. Subscriptions and Payments

Subscription Options

• We offer various subscription plans including monthly, annual, and premium tiers.
• Current subscription options and prices are displayed in the app before purchase.
• Prices may vary by region and are subject to change.
• All prices shown include applicable taxes where required.

Auto-Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• The renewal charge will be for the same subscription tier unless you change your subscription preferences.

Managing Subscriptions

• You can manage and cancel subscriptions through your device's account settings:
  • iOS: Settings > [Your Name] > Subscriptions
  • Web: Account settings on our website
• Cancellation takes effect at the end of the current billing period.
• You will continue to have access to premium features until the end of your paid period.

Payment Processing

• iOS purchases are processed through Apple In-App Purchases.
• Web purchases are processed through Stripe.
• Payment will be charged to your selected payment method at confirmation of purchase.

Refunds

• iOS purchases: Refunds are handled directly by Apple according to their policies.
• Web purchases: Contact support@orky.ai within 7 days of purchase for refund requests.
• No refunds are provided for partial subscription periods.

Free Trials

• If we offer a free trial, you will not be charged until the trial period ends.
• Any unused portion of a free trial period will be forfeited when you purchase a subscription.

3. Use of Service

• This Service is designed for interview practice and professional development.
• You agree to use the Service only for lawful purposes.
• You will not misuse, abuse, or attempt to manipulate the AI system.
• You retain ownership of content you create but grant us license to use it to provide and improve our services.

4. Disclaimers

• We make no guarantees regarding job placement, interview success, or employment outcomes.
• The Service is provided for educational and practice purposes only.
• AI-generated feedback is advisory and should not be considered professional career counseling.

5. Intellectual Property

• All content, features, and functionality of the Service are owned by Orky Inc. and are protected by copyright, trademark, and other intellectual property laws.
• You may not copy, modify, distribute, or reverse engineer any part of the Service.

6. Privacy

Your use of our Service is also governed by our Privacy Policy, available at https://orky.ai/auths/privacy/

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

8. Account Termination

• We reserve the right to suspend or terminate accounts that violate these Terms.
• You may delete your account at any time through the app settings or by contacting support.
• Upon termination, your right to use the Service will immediately cease.

9. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes through the app or via email. Continued use of the Service after changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
